Resisting Arrest and Assault on Police Officer Charges Dismissed

Van Nuys Superior Court (January 2019) Michael A. Goldstein’s client was charged with assault on a police officer and resisting arrest following a traffic stop. During the traffic stop, the driver was arrested for DUI. During the arrest, the driver tried to escape and got into a physical altercation with both officers. While the officers tased him repeatedly, our client is alleged to have attacked one of the officers by kicking him and trying to push him off of the driver who continued to fight with the officers. Our client was arrested for felony battery on a police officer. Our client denied the attack on the officers and Michael requested body worn video footage of the entire arrest from LAPD. After a review of the body worn video, the prosecutor agreed to dismiss all charges.
